Photo & Likeness Terms

These terms explain what happens when you upload photos to Shape Your Tale. You must tick the acceptance box on the upload step before we can use those photos. That box is never pre-ticked.
Who may upload a photo
You must be at least 18 and able to agree to these terms. Shape Your Tale is made for adults to use together with children, not for a child to use on their own.
You may only upload a photo if one of these is true:
- the photo is of you, or
- the photo is of someone who has agreed that you may use it for this purpose, or
- the photo is of a child and you are that child's parent or legal guardian.
Do not upload photos of other people's children, classmates, or anyone who has not agreed. Do not upload images you found online, or photos that contain other identifiable people in the background if you do not have their permission.
What we use the photos for
We use the photos for one purpose: to generate a storybook character that resembles the person in them, and then to illustrate the pages of the fairytale you create with that character.
We do not:
- sell your photos or the likeness we generate from them
- use them for advertising or to recommend products
- use them to train our own AI models
- use them to uniquely identify, authenticate, or recognise anyone (this is not facial recognition, and we do not build a biometric ID from your photos)
How we process a photo
Before a photo leaves your device we resize it and re-encode it as a JPEG. That step also drops embedded location data (for example GPS in the file's EXIF).
We then send the resized photo to our AI provider, Google Gemini, with a prompt asking it to draw a children's-storybook character that keeps the person's face and likeness. Gemini returns illustrated portraits. You pick one, and we keep that generated portrait as the hero of your story.
We do not store the original photos after that generation request. What we keep is the illustrated character and the later story-page drawings, so you can come back to your tale, download it, or print it.
When we illustrate later pages we send that generated portrait back to Gemini so the hero stays consistent from page to page. Original camera files are not sent again.
Who else sees the photos
Google processes the photos solely to produce the illustrations you asked for. On a paid Gemini API plan, Google's terms say they do not use your prompts or uploaded files to train their models. Google may still retain a request for a limited time for security, abuse, and operational reasons. We cannot promise that Google deletes a request the instant it is answered.
Generated images are stored with our hosting and database provider (Supabase) so we can show your stories back to you. Authentication providers (Google or Meta, if you sign in with them) do not receive the photos you upload in the wizard.
Your photos, your likeness, our limited permission
You keep the rights in the photos you upload. By ticking accept you grant us the limited permission we need to process those photos and the generated likeness as described here — including sending them to Gemini and storing the illustrated results in your account.
The illustrated character and story remain yours to read aloud, print, and share with family and friends. We will not put your photos or a generated likeness in our marketing without asking you first.
Because the pictures are drawn by AI, the likeness will not be perfect, and it may include oddities. The result is a storybook illustration, not a photograph, and it is AI-generated.
Children
If a photo shows a child, ticking accept is you, as parent or guardian, giving permission for us to process that child's image for this story — and only for this story. Please do not type the child's full name, address, school, or other identifying details into the app.
We do not knowingly create accounts for anyone under 18. If you believe we have information about a child that should not be here, email lefosm@gmail.com and we will delete it.
How long we keep things, and how you withdraw
You can close the wizard without uploading, and nothing is sent. After a character exists, you can delete that character and its stories in the app, or ask us to delete your account and everything with it by emailing lefosm@gmail.com. We aim to complete deletion requests within 30 days.
Withdrawing this permission stops us using the photos for new generation. It does not automatically erase a story you have already made until you delete that story or your account. Our Privacy Policy explains your rights of access, correction, export, and erasure under EU data protection law.
Where this service is offered
Shape Your Tale is offered first in the EU (and the rest of the EEA and the UK). The lawful basis we rely on for this photo processing is your consent. You give it by ticking the box; you can withdraw it as described above.
If we later offer the service in the United States, these same rules still apply: an adult account, parent or guardian permission for a child's photo, no sale of photos, and no use of photos to identify people. We will add any extra steps US law then requires (including COPPA for children under 13) before collecting photos from US users.
Changes
If we change how we process photos we will update the date at the top of this page. A later change does not apply to photos you already uploaded unless we ask you to accept the new terms.
